To,
Hon. AMC.,
H/East,
Mumbai

Dear Sir,
Namaskar.

After long gap yesterday i.e. 3rd August I visited my old building . Pl. find enclosed pictures clicked thru my mobile which are self explanatory.
Before I make further submission here is a brief history of same:
Around 1942 one good decent goan Christian family  built this building and named it Dias Bungalow.
They kept three tenants in building at different span of time.
1.      My grand father Late M M Tholiya who was then running Jawahar Stores, Jawahar Hotel, etc. . In 1991 I inherited his shops. Subsequent years I started taking interest and started TV shop and wound up some of my grandfathers business. Due to flooding and leakage from first floor ( percolating from terrace to first floor and also from toilet blocks of first floor) lot of damage was caused to me repeatedly. This forced me to shut my business. However during interim period that is in 1989 I purchased from landlord this building.
2.      Late Mr Choudhary was running Bharat Lodge and subsequently inherited by Mrs  Bina , his wife. Her rent since 1950’s is still only Rs 138/- p.m. .
3.      Dattatraya Paan Bidi shop. Their rent since inception of tenancy is Rs 40/- p.m.
4.       My grandfather on humanitarian pleadings by one Hamirsingh and his son Kishansingh gave a 50 sq feet space on west side otla of our shops to run a tea stall as their village was suffering due to drought and they were dying of hunger. It was agreed that he will pay Rs 5 per day to my dadaji. But he developed local connections and started wielding muscle and political power. His good contacts were one Dada running liquor shop and subsequently one Suresh Thakur who was also a nagar sevak due to blessing of big leader from UP. Under their shelter he expanded unauthorizedly  his  stall and started calling same as Ranjit Hotel The same Ranjit Hotel is still running without any municipal licence, without police license and now without FSSAI. Several complaints to all concerned agencies were made. But it yielded no results as there was god father behind this Ranjit Hotel owner. So he pays nothing to owners of property but does roaring business without licence and without paying any taxes. ON my complaint Reliance energy had raided his hotel where he was using stolen power supply. He abandoned several water connections evading bills of thousands and kept on taking new connections.

So my income from building is Rs 178/- p.m. that is Rs
But I hv to pay ever increasing BMC property taxes of Rs 4882/-  and so also I have to pay Rs 3145/- per year to land revenue dept.

I also have to pay for some bear minimum emergency. I am maintaining  the flower bed developed by BMC and the then municipal corporator Shri George Abraham and Shri Basant Kshirsagar. This is costing me another Rs 10000/-  per year.

Municipal Corporation of Greater Mumbai- pull down the building numbers 13,14,15 and 16 which are in dilapidated condition. = petitioners have no legal right to continue to live in the existing buildings as this Court by its previous order, sought to be modified, has already passed an order for their eviction from the premises in question.= In view of the existing precarious nature and status of the buildings in question which is informed to be extremely grave, we cannot permit the petitioners to continue to live in the existing buildings for more than a fortnight which they have been ordered to vacate. Therefore, we permit them to exercise their option of shifting either to Mahul, Chembur or the Transit Camps Nos. 13A and 13B after a fortnight when the transit camps are made fit for habitation with essential and basic amenities. However, if some of the occupants of the building No. 13 and top floor of building No. 14 wish to continue in the existing buildings at their own risk even after a fortnight, they are at liberty to seek permission from the Bench which had passed the order sought to be modified as we have taken up this application for modification only in view of its urgency.- However, considering the peculiar facts and circumstances as also taking into account the humanitarian consideration for the occupants of the building No. 13 and top floor of building No. 14, we accede to the request of the occupants of the building No. 13 and top floor of building No. 14 communicated through their counsel that if they wish to continue to live in the existing buildings beyond of a period of fortnight until they move the Regular Bench, they may do so at their own risk and in case the buildings in question falls down in the meantime and the occupants suffer loss in any manner, the whole and sole responsibility shall be of the occupants of the those buildings and the Municipal Corporation of Greater Mumbai shall not be liable in any manner for any consequence that might follow. 14. The Applicant/respondent No.1 however, shall make the Transit Camp Nos. 13A and 13B habitable with all basic amenities within a fortnight but not later than 30.6.2013. It was further stated by the learned Attorney General that the respondent No. 1 will offer all assistance and logistic support to the evacuees for shifting them from the existing building No. 13 and top floor of building No. 14 to Mahul, Chembur and continue to live there until they reshift to the Transit Camp Nos. 13A and 13B after a fortnight or till such time when the Transit Camps are complete to their satisfaction. 15. It is made clear that the Transit Camp Nos. 13A and 13B shall provide all basic amenities required for human habitation but the word “habitation” will not be construed so as to insist for fancy fittings in the Transit Camps. = published in http://courtnic.nic.in/supremecourt/qrydisp.asp

Tenants can't force landlord to move kin out of property: HC

Tenants can't force landlord to move kin out of property: HC

"A tenant or the court can't dictate a landlord on what is bona fide and reasonable need... landlord is the best judge of his requirements," said the judge.
The high court set aside as "perverse" a lower court's order that directed the landlady's son and his family to move to Badlapur where her daughter-in-law has a house. This, despite the tenant owning a home in Dombivli.

"The (lower) court wants the landlady's family to be separated, some members to live in Thane and others in Badlapur, when they have a house of their own in Thane," said the judge. "It is difficult to understand how the landlady's family can be directed to be separated and the tenant allowed to live on the rented premises, when, by her own admission, she owns a building in Dombivli."

The flat is on the ground floor of Thane's Shrikripa Building, which the landlady, Sudha Barve, rented out to Ramesh Padhye in 1974. Once he died, Padhye's wife Ranjana and her two children continued living there. In the mid '90s, Barve moved court, seeking their eviction; she had complained that rents were not paid, a creche was run illegally from the flat and alterations were made to the flat without permission. Barve also said she stayed in a 300-sq-ft flat and needed the rented place to house her family comprising her divorced daughter, son, his wife and their two children. While the trial court in 2002 held in Sudha's favour, the appellate court reverse the verdict. It asked Sudha's son to move out with his family to Badlapur.

During the pendency of the case, Barve died. The HC even said after her death, "it cannot be said the space would be enough for the family..." consisting of her daughter, son, daughter in law and their two children. It is to be noted that the family is a growing family and as such the requirement cannot be said to be fanciful.'' and struck down the appellate court order.
